1. ACCEPTANCE OF TERMS

By downloading, installing, or using the EmotiQ mobile application ("App"), you agree to be bound by these Terms of Use ("Terms"). If you do not agree to these Terms, do not use the App.

2. DESCRIPTION OF SERVICE

EmotiQ is an emotional tracking and emotional intelligence wellness iOS mobile app that provides:

• Voice based emotion analysis using advanced digital signal processing and speech recognition algorithms to detect emotional states
• Personalized voice affirmations using ElevenLabs voice cloning technology
• Emotional wellness coaching with personalized recommendations and interventions
• Goal setting and progress tracking for emotional wellness improvement
• Push notifications for wellness reminders and motivational messages
• Subscription services for premium features and enhanced capabilities

3. USER ACCOUNTS AND ELIGIBILITY

3.1 Account Creation

• You may be required to create a voice profile to access certain features
• You must provide accurate and complete information during registration
• You are responsible for maintaining the confidentiality of your account credentials
• You must be at least 18 years old to use this App

3.2 Account Security

• You are solely responsible for all activities under your account
• Notify us immediately at EmotiQApp@gmail.com of any unauthorized use
• We are not liable for any loss or damage from unauthorized account access

4. VOICE DATA AND AI PROCESSING

4.1 Voice Recording and Analysis

• The App records your voice for emotion analysis and voice cloning features
• Voice recordings are processed using artificial intelligence and machine learning
• Raw voice recordings are processed and then deleted from our systems
• Emotion analysis results are stored locally on your device

4.2 Voice Cloning Technology

• Premium features include voice cloning using ElevenLabs technology
• Your voice data is processed by our third-party partner ElevenLabs
• Voice clones are created solely for your personal use within the App
• You retain ownership of your original voice recordings

4.3 Data Storage

• User preferences and emotional analysis results are stored locally using Core Data
• Voice cloning data is handled according to ElevenLabs' privacy practices

5. SUBSCRIPTION SERVICES AND PAYMENTS

5.1 Subscription Plans

• Premium features require paid subscriptions (monthly or one-time purchases)
• Subscription fees are charged through Apple's App Store payment system
• Prices and billing periods are clearly displayed before purchase

5.2 Billing and Renewals

• Subscriptions automatically renew unless cancelled through your App Store account
• You can manage subscriptions through your device's App Store settings
• Refunds are subject to Apple's App Store refund policy

5.3 Free Features

• Basic emotion analysis and wellness features are available without subscription
• Premium features include unlimited voice generation and advanced analytics

6. ACCEPTABLE USE

6.1 Permitted Use

• Use the App for personal, non-commercial emotional wellness purposes
• Follow all applicable laws and regulations
• Use the App in a manner consistent with its intended purpose

6.2 Prohibited Activities

You may not:

• Use the App for any illegal or unauthorized purpose
• Attempt to reverse engineer, hack, or compromise the App's security
• Share your account credentials or voice clone with others
• Use the App to harass, abuse, or harm others
• Interfere with the App's functionality or other users' experience
• Violate any applicable laws or regulations

7. INTELLECTUAL PROPERTY RIGHTS

7.1 Our Rights

• The App and its content are protected by copyright, trademark, and other intellectual property laws
• We retain all rights to the App's design, functionality, and proprietary technology
• EmotiQ trademarks and logos may not be used without our written permission

7.2 Your Rights

• You retain ownership of your personal voice recordings and data
• You grant us a limited license to process your data as described in these Terms and our Privacy Policy
• Your voice clone is for your personal use only within the App

8. THIRD-PARTY SERVICES

The App integrates with third-party services including:

• ElevenLabs: Voice cloning and speech synthesis
• OneSignal: Push notification delivery
• RevenueCat: Subscription and payment processing
• Apple Services: App Store payments and analytics

Use of these integrated services is subject to their respective terms of service and privacy policies. We are not responsible for third-party service availability, performance, or data handling practices.

• Emotion analysis results are estimates based on AI technology and may not be completely accurate
• AI technology is continuously improving but is not infallible
• Use analysis results as guidance for wellness, not as absolute determinations

11.3 Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW:

• WE ARE NOT LIABLE FOR ANY INDIRECT, INCIDENTAL, OR CONSEQUENTIAL DAMAGES
• OUR TOTAL LIABILITY IS LIMITED TO THE AMOUNT YOU PAID FOR THE APP
• WE DISCLAIM ALL WARRANTIES EXCEPT AS REQUIRED BY LAW

12. INDEMNIFICATION

You agree to defend, indemnify, and hold us harmless from any claims, damages, or expenses arising from:

• Your use of the App
• Your violation of these Terms
• Your violation of any third-party rights
• Any content you submit through the App

13. TERMINATION

13.1 Termination by You

• You may stop using the App at any time
• Cancel subscriptions through your App Store account settings

13.2 Termination by Us

We may terminate your access if you:

• Violate these Terms
• Engage in prohibited activities
• Use the App in ways that harm our service or other users

13.3 Effect of Termination

• Your right to use the App immediately ceases upon termination

• Certain provisions of these Terms survive termination

14. CHANGES TO TERMS

15. GOVERNING LAW AND DISPUTES

15.1 Governing Law

These Terms are governed by the laws of Nigeria. EmotiQ and you irrevocably consent that the courts of Lagos, Nigeria shall have exclusive jurisdiction to resolve any dispute arising from these Terms.

15.2 Dispute Resolution

• Disputes should first be addressed through direct communication with us
• Parties agree to attempt informal negotiations for at least 30 days before formal proceedings
• Any unresolved disputes shall be resolved through binding arbitration in Lagos, Nigeria
• Arbitration proceedings shall be conducted in English with 2 arbitrators
• Class action lawsuits are waived to the extent permitted by law
